1. The agreement
These Terms of Use (the "Terms") form a binding agreement between you and Bayit Lepleitot, a charitable association registered in Jerusalem, Israel, and operating sister entities in the United States (a 501(c)(3) public charity) and Mexico (a Donataria Autorizada). When you visit blphome.org, donate through it, sign up for our newsletter, or contact us through any form on the site, you are accepting these Terms. If you do not accept them, you should not use the site.
We may update these Terms from time to time. When we do, the revised version takes effect thirty days after we post it. Continued use of the site after that date constitutes acceptance of the revised Terms. If you do not agree with a change, your remedy is to stop using the site. For material changes that affect active donors, we will additionally send notice by email.
2. What this site is, and is not
blphome.org is the public-facing website of Bayit Lepleitot. It exists to tell the story of our home, describe our programs, accept charitable donations, and let visitors get in touch with us. It is not a portal for our staff, a system of record for the children in our care, or a forum for public discussion. We do not operate comment sections, user-generated content features, or any place on this site where third parties may publish material.
Photographs, illustrations, video, written content, and code on this site are owned by Bayit Lepleitot or licensed to us. You may share links to the site freely. You may quote from any page for journalistic, scholarly, or educational purposes under fair-use or fair-dealing principles. You may not copy entire pages, mirror the site, scrape its content for commercial purposes, or use any of our material to imply endorsement of a third party's products or services. We do not license our material for use in artificial-intelligence training datasets and do not consent to such use.
3. Donations
Donation amounts shown on our forms are charged in the currency displayed at checkout - typically USD, MXN, EUR, GBP, or ILS, depending on your selection. Card payments are processed by Cardknox/Sola; we never see or store your card number. Once your gift has been authorized by your card issuer and confirmed by Cardknox/Sola, it is final. Charitable donations are not subject to a statutory cooling-off period under any of the jurisdictions in which we operate.
If you believe a donation was made in error - a wrong amount, a duplicate charge, an unrecognized transaction - write to donations@blphome.org within 90 days and we will investigate. Genuine errors are refunded promptly and without question. Disputes resolved in favor of the donor result in a refund of the donation and, where applicable, a void of the corresponding tax receipt; we will let you and your tax authority know that the receipt is no longer valid. Monthly recurring donations may be paused, modified, or cancelled at any time by writing to the same address or following the link in your most recent receipt.
We reserve the right to decline any donation, for any lawful reason, and to refund a gift after acceptance if we determine that retaining it would be inconsistent with our mission, our policies, or applicable law (for instance, sanctioned-party screening). Such a decision is rare and is made by the board.
4. Tax receipts
Tax receipts are governed by the Tax Information page, which is incorporated into these Terms by reference. The short version: donors in the US, Mexico, and Israel receive receipts that are deductible under the rules of their home jurisdiction. Donors elsewhere may receive an acknowledgement letter, but the deductibility of the gift depends entirely on their local law. We do not provide tax advice and you should consult your own advisor.
5. Newsletter and communications
If you sign up for our quarterly newsletter, we will send you four emails a year and occasional invitations to donor events. Every email contains a one-click unsubscribe link. If you donate, we will also email you a receipt, an annual statement in January, and - at most - one or two ask emails per year. We do not run year-end direct-mail campaigns of the kind common in US fundraising. We do not auto-enroll donors in mailing lists; you must opt in.
6. Privacy
Our handling of your personal information is described in the Privacy Policy, which is incorporated into these Terms by reference. By accepting these Terms you are also accepting the Privacy Policy.
7. Third-party links and embeds
Our site may link to third-party websites - for example, regulator pages, news articles about the home, or partner organizations. We do not control those sites and are not responsible for their content, their privacy practices, or any harm that may come from your use of them. The presence of a link does not constitute endorsement.
8. Disclaimers and limitation of liability
The site is provided "as is" and "as available." We make no warranties - express or implied - about its accuracy, completeness, fitness for a particular purpose, or non-infringement. To the maximum extent permitted by law, Bayit Lepleitot and its officers, directors, staff, volunteers, and contractors are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the site. Our aggregate liability for direct damages, in any case, is limited to the amount of any donation you have made to us in the twelve months preceding the claim.
Nothing in this section limits or excludes liability that cannot be limited or excluded under the law of your jurisdiction - for instance, liability for fraud, death, or personal injury caused by negligence under English or Israeli law.
9. Acceptable use
You agree not to: attempt to gain unauthorized access to any part of the site; introduce viruses, worms, or other malicious code; conduct automated scraping at a rate that interferes with service for other users; impersonate any person or entity, including Bayit Lepleitot or its staff; or use the site to harass, defame, or threaten any person. Violations may result in suspension of your access and, where appropriate, referral to law enforcement.
10. Governing law and disputes
These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the site shall be resolved exclusively in the competent courts of Jerusalem, Israel - except that, if you are a consumer in the European Union, the United Kingdom, Mexico, or the United States, you retain the right to bring proceedings in the courts of your habitual residence, and we retain the right to seek injunctive relief in the jurisdiction where you reside.
Before initiating formal proceedings, we ask that you write to office@blphome.org and give us thirty days to attempt a resolution. Most disputes are resolved at this stage.
11. Severability
If any provision of these Terms is held to be unenforceable, the remaining provisions remain in full force. The unenforceable provision will be reformed by the smallest amount necessary to make it enforceable.
